PTX Therapy, LLC and its affiliates (collectively, “PTX”) own and operate these Internet-based health information and communication service websites and mobile applications (the “Sites and Mobile Apps”). PTX respects your privacy and is committed to protecting it. PTX is providing this Privacy Policy to inform you of our current Privacy Policy and practices, the choices you can make about the way your information is collected online, and how that information is used. We hope that this will remove any concerns you may have about supplying information to us and make visiting the Sites and Mobile Apps a rewarding experience.

By using or browsing the Sites and Mobile Apps, you acknowledge that you have read, understood and agree to this Privacy Policy and all applicable laws and regulations. If you do not agree to the terms of this Privacy Policy, please do not use or access the Sites and Mobile Apps or provide information to us. We may change this Privacy Policy at any time and without any notice to you, so we recommend that you periodically visit this page to review our current Privacy Policy. Sites and Mobile Applications Covered by this Privacy Policy

This Privacy Policy applies to the Sites and Mobile Apps and all other websites, mobile applications, and domains owned by PTX and/or its affiliates. The Sites and Mobile Apps may provide links to third-party websites for your convenience and information. If you access those links, you will leave the site or mobile application. We do not control those sites or their privacy practices, which may differ from our own privacy practices. This Privacy Policy does not cover any personal data that you choose to give to unrelated third parties. You acknowledge that we do not monitor or control the information collected by such sites or the privacy practices of any third parties, and we are not responsible for their practices or the content of their sites.

Personally Identifiable Information

Please note that you can access and browse the Sites and Mobile Apps without disclosing your personal data. If you choose to register with the Sites and Mobile Apps, purchase a subscription on the Sites and Mobile Apps, or otherwise voluntarily submit information to the Sites and Mobile Apps, you may be requested to provide contact and other personally identifiable information, including your name, address, telephone number, email address, credit card number, a unique login name and a password. In order to tailor our subsequent communications to you and continuously improve our products and services (including registration), we may also ask you to provide us with information regarding your age, levels of exercise intensity, personal and/or professional interests, demographics, health problems and/or history. We may record and use this information to contact you to help about the services on the Sites and Mobile Apps in which you have expressed interest, to assist you with a transaction, and/or send you information about other PTX products and services that may be of interest to you. We may also use this information for our own internal business purposes, including to facilitate your relationship with us, as permitted by law or regulation.

Sharing of Information

PTX may use internal or third-party service providers to operate the Sites and Mobile Apps and may employ other persons to perform work on our behalf, such as sending postal mail and e-mail. These persons may have access to the personally identifiable information you submit through the Sites and Mobile Apps, but only for the purpose of performing their duties. These persons may not use your personally identifiable information for any other purpose.

PTX will not share non-public personal information with any other third parties without your permission, unless required by law enforcement action, subpoena, local law or when we reasonably believe that such disclosure is necessary to protect our systems, our business or the rights of others, or as otherwise provided in this Privacy Policy

It is also possible that PTX and/or its affiliates could merge with or be acquired by another business entity or their respective assets could be acquired. Should such a merger or acquisition be contemplated or occur, PTX and its affiliates expressly reserve the right to share some or all of your personally identifiable information with the acquirer or merger partner, as applicable.

Aggregate Data

The Sites and Mobile Apps may collect data through a variety of different methods. For instance, we may automatically log data by means of programming and we may link certain information as well. The Sites and Mobile Apps may collect non-personal technical information about your session, such as your browser type, Internet service provider, platform type, Internet Protocol (IP) addresses, referring/exit pages, operating system, date/time stamp. If we use this information at all, it will be on an aggregate basis (which does not identify individual users) to analyze trends, diagnose problems with our server and administer the Sites and Mobile Apps, to track user movement and use, and to gather broad demographic information. We use this information to better understand your needs and provide you with better service.

One way we may elect to gather this information is through the use of cookies. Cookies are small computer files stored on your computer’s hard drive that save and retrieve information about your visit to the Sites and Mobile Apps. We may use cookies to store personal data and link information. If you are uncomfortable regarding the use of cookies, you may disable cookies on your computer by changing the settings in the preferences or options menu in your browser. Keeping your Information Secure

The security of your personal information is important to us; however, no security system is guaranteed to be 100% secure. While we strive to protect your personal information, PTX cannot guarantee or warrant the security of our servers nor can we guarantee that information you supply through the Sites and Mobile Apps will not be intercepted while being transmitted over the Internet.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. We use encryption when collecting or transferring sensitive data such as credit card and personal information.

Credit Cards

All credit card transactions conducted on the Sites and Mobile Apps are processed through secure site services. Credit card numbers are used only for payment processing for requested transactions and are not retained for other purposes. PTX denies liability for damages incurred through the collection and use of customer data, such as through credit card fraud or misuse. While no security systems are infallible, PTX will prosecute any unauthorized access to secured information to the fullest extent of the law. PTX periodically reviews and updates security measures to insure appropriate and commercially reasonable protections for the membership.

Children’s Privacy

PTX is committed to protecting the privacy of children and we encourage parents to take an active role in their children’s online activities and interests. PTX does not knowingly collect information through the Sites and Mobile Apps from children under the age of 13 and PTX does not target the Sites and Mobile Apps to children under 13.

BBBOnLine

PTX supports the Council of Better Business Bureau’s BBBOnLine Privacy Program. It is our intent to comply with and apply for the BBOOnline Privacy Seal. Further information about the BBBOnLine privacy standards is available at www.bbbonline.org.

Changes to this Policy

If, at any time in the future, it is necessary to disclose any personal information in a way that is inconsistent with this Privacy Policy, we will give you advance notice of the proposed change so that you will have the opportunity to “opt out” of such disclosure. If there are updates to the terms of this Privacy Policy, we will post those changes and update the revision date in this document, so you will always know what information we collect online, how we use it, and what choices you have. By continuing to use the Sites and Mobile Apps after any changes are posted, you acknowledge your acceptance of such changes.

Other Terms and Conditions

If you choose to visit the Sites and Mobile Apps, your visit and any dispute over privacy is subject to this Privacy Policy and our Terms of Use, including, but not limited to, disclaimers of warranty, limitations of liability, arbitration of disputes and application of the law of the State of Texas.
